1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Sky Engineering EOOD ("Company", "Flowix", "we", "us", or "our"), regarding your access to and use of the Flowix simracing telemetry platform, website (https://flowix.net), services, and the downloadable background agent software (collectively, the "Service").
By registering an account, installing the Flowix Agent, or accessing the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all access and use of the Service.
2. Service Description & Software Delivery
Flowix is a cloud telemetry recording, statistics, and analysis platform designed for simracing drivers. The Service provides lap delta visualizations, physics channel tracking (57 channels), global leaderboard rankings, and data retention.
Access to the web platform is provided immediately upon account registration. The Flowix background telemetry client is provided as a digital download for Windows PCs. Software access and premium tier entitlements are delivered instantly via electronic means upon subscription activation.
3. Merchant of Record & Payment Processing
Merchant of Record: Our order process is conducted by our online reseller and Merchant of Record, Paddle.com Market Limited ("Paddle"). Paddle is the Merchant of Record for all our orders. Paddle handles billing, payment processing, tax compliance (including VAT/sales tax), invoice issuance, and customer payment inquiries.
When purchasing a Flowix PRO subscription, your financial relationship for payment collection is with Paddle, governed by Paddle's Buyer Terms and Conditions and Privacy Policy.
4. Subscriptions, Pricing & Billing
- Free Tier: Provides basic telemetry analytics, global leaderboard access, and 1 month (30 days) of telemetry cloud storage at no monetary cost.
- PRO Subscription: Paid subscription (available on monthly or annual billing terms) providing 1 full year (12 months) of cloud telemetry storage, telemetry privacy controls, CSV export, and priority processing.
- Automatic Renewal: Paid subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled prior to the renewal date.
- Price Changes: We reserve the right to adjust pricing. Any price modifications will be communicated in advance before taking effect on subsequent billing cycles.
5. Cancellation & Refund Policy
You may cancel your PRO subscription at any time through your account settings or the Paddle Customer Portal. Upon cancellation, your PRO benefits will remain active until the end of your current paid billing period. 6. User Accounts & Conduct
You agree to provide accurate registration information and keep your credentials secure. You may not attempt to reverse engineer, abuse, DDoS, inject malicious payloads, or circumvent telemetry validation safeguards on the Flowix network.
7. Intellectual Property
All software, algorithms, UI design, trademarks, and documentation related to Flowix are the exclusive property of Sky Engineering EOOD. You retain ownership of your driving telemetry data.
8. Disclaimer of Warranties & Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Sky Engineering EOOD disclaims all warranties, express or implied. In no event shall Sky Engineering EOOD be liable for indirect, incidental, special, or consequential damages.
9. Governing Law & Contact Information
These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria and the European Union.
